After the new criminal laws, the government has introduced the new Bhartiye Vayuvan Vidheyak Bill 2024 which is set to replace the 90 year old Aircrafts Act of 1934. The proposed legislature consisting of 44 clauses, seeks to streamline India’s newly expanding aviation sector. The features of the bill are as follows :
Enhanced role of DGCA : This bill will increase the power of Directorate General of Civil Aviation (DGCA). It will the primary regulatory authority in Indian aviation sector. They will have a say on various fields of aviation like aircraft design, manufacturing, maintaince, airworthiness.
Establishment of Aircraft accidents Investigation Bureau : An independent agency is created to conduct through investigations into aviation accidents and incidents, promoting transparency and accountability in industry.
New means of screening passengers before boarding fight are introduced. This includes better passenger screening, baggage inspection and airport security protocols.
Emergency Powers with Central Government : The central government shall have special powers in a case of emergency to address critical aviation situations enabling swift and decisive action plan to protect public safety.
Establishment of a Bureau of Civil Aviation Security : The bill aims to establish a Bureau of Civil Aviation Security to exclusively focus on aviation security matters.
Regulation related to aircraft design, aircraft maintenance and related equipment will take place in order to minimise accidents.
Establishment of a new appeals process will take place which will include ana additional lawyer of appeal before final decisions, offering more opportunities for affected parties to contest outcomes.
Issuance of Radio Telephone Operator Certificates and Licences : These will be issued to individuals involved in operating and maintaining aircraft radios, aligning with international telecommunication standards.
