On thursday, the Delhi High Court directed US electric vehicle maker Tesla inc. and gurugram based Tesla Power Inida `to settle their dispute over the alleged infringement of trademark through mediation. The HC directed both companies to appear before the Delhi High Court Mediation and conciliation Centre.
Gurugram based Tesla Power submitted that it was following the undertaking given to court that it had no plans to enter Indian electric vehicle market. This was strongly opposed by the US based tesla inc. Counsel appearing for Tesla Power was none other than J Sai Deepak who said that tesla power was not in violation of the trademark as Tesla was not a coined mark and the US company cannot claim monopoly over it.
Tesla Inc. had moved to court allegeing the infringement of its trademark in India was causing confusion among consumers and potentially harming its business interests. Tesla inc. also put on record that consumers were mistakenly buying Tesla Power’s Battery assuming they were with the US company and thereafter registering complaints with them. To which Tesla Power responded that Tesla inc. was not involved in manufacturing of batteries but in EVs, whereas we are not in the EV industry but in battery manufacturing.
